Joseph Stimmel Obtains $2 Million Liability Verdict in New York

Joseph C. Stimmel, Esq. Senior Associate at Varcadipane & Pinnisi, P.C. secured a $2,00,000 liability recovery in a slip and fall trial

Following a roughly week-long jury trial in New York, Joseph Stimmel of Varcadipane & Pinnisi P.C. recently secured a liability verdict in favor of the firm’s client who sustained severe injuries to her spine and shoulder because of a slip and fall accident. The Firm’s client required multiple surgeries to her spine and shoulder, which also included implantation of substantial surgical hardware into her spine. Her injuries also left her with chronic pain and substantial physical disability, prevented her from returning to work, and significantly restricted her daily living and ability to care for herself.

The defendant property owner refused to accept responsibility for the accident, and instead repeatedly sought to blame the client for her own accident. However, at trial, Mr. Stimmel demonstrated that a dangerous condition existed on the property, the defendant owner failed to remedy it despite ample opportunity to do so, and that the owner did very little, if anything, to ensure that its property was in a reasonably safe condition.

The court split up (bifurcated) the trial into two trials with separate juries. The first trial successfully proved that the defendant owner was negligent and liable for the client’s accident. A second trial was planned to prove the extent to which the accident caused the client’s medical problems and what the dollar amount of her damages should be. However, due to Mr. Stimmel’s strong success during the first trial (the liability trial), he successfully negotiated a 2-million-dollar settlement on the client’s behalf and before the second trial even started. Mr. Stimmel obtained this result despite the client having extensive, pre-existing or pre-accident medical problems, some of which affected the very same body parts that the client injured and exacerbated during her slip and fall accident.
