Following a roughly two-week jury trial in Middlesex County, New Jersey, Joseph Stimmel of Varcadipane & Pinnisi P.C. obtained a verdict in favor of the firm’s seven clients in an employment law case for unpaid wages. The client plaintiffs were employees of a cybersecurity company who were misled by their employer to work for several months without pay, and with promises of future paychecks that never came. At trial, Mr. Stimmel successfully held the company’s senior leadership personally liable for the company’s failure to pay the wages, under New Jersey’s Wage Payment Law and the Wage and Hour Law.
A particular challenge in the case was proving that one of the company’s senior managers, a brother of the company’s CEO, should also be personally liable as an “employer” under N.J. law. The brother of the CEO helped the CEO run the company, but he attempted to do so in the shadows and off the books in an ill-fated attempt to avoid his liability for the unpaid wages. The brother even sent an alleged resignation letter during the period of the unpaid wages, claiming he was no longer involved in the company. Nonetheless, Mr. Stimmel overcame these defenses and proved that the brother did in fact run the company alongside the CEO, and that he remained significantly involved well-past his alleged resignation. In addition, Mr. Stimmel successfully proved all the employees’ claimed amounts of unpaid wages, and reconstructed the wages through subpoenas to payroll companies, company bankruptcy records, and other means.
Ultimately, Mr. Stimmel obtained a verdict and judgment for roughly $1.4 million dollars. The award included all of the unpaid wages sought by the plaintiffs and, as allowed by N.J. law, triple damages for three times the amount of the unpaid wages owed and an award of attorney’s fees that the defendants must pay.
According to Mr. Stimmel, “An employer’s payment of wages to its employees is one of its most important responsibilities. I’m glad we were able to achieve justice, hold people accountable, and stand up for dedicated workers that were mistreated and taken advantage of.”
